law booksA tenant in Chippewa County, Wisconsin is suing her landlords after she was attacked by her daughter’s ex-boyfriend.

The woman was sleeping on the couch when the man, wielding a knife, entered the rental home through a broken door which the tenant had asked the landlords to repair, according to a local news report.

The tenant was stabbed in the neck and nearly died from her injuries. Her attacker is in prison.

The tenant claims she had made several requests to fix the door, which did not close firmly and could not be adequately locked. She claims the landlords are negligent and is seeking an unspecified amount of damages.

    I responded to Mark on ridiculous landlord liability exposure in the previous post. This is exactly what I’m talking about. A tenant who doesn’t secure their premises during the time it takes the landlord to make repairs doesn’t gain my sympathy. Wonder how the door got broken in the first place?

    It is always so easy to sue a landlord because of the stupidity of the tenant. In california, Judges love these type of cases to stick it to the landlord.

    What does it take to do a simple repair. Why didn’t he fix it?

    Get all the facts before you judge either the tenant OR the landlord. Perhaps the repair was going to be very difficult or costly. There HAS to be SOME personal responsibility on the behalf of the tenant. Where I have rentals, if I don’t get a repair order taken care of in a certain time frame the tenant has the right to get it fixed themselves and bill me for the cost.
