Is Landlord Liable for Bizarre Injury?

 A landlord in Oregon is accused of causing a tenant’s death by denying a request for a disabled parking space.

According to a news article, the tenant died from injuries he sustained from his walker while in the bathroom of his apartment a month after he requested close-in parking.  The man allegedly was using the walker because he fell in the parking lot.

The Oregon Department of Justice will be prosecuting the case on behalf of a state agency, the Oregon Bureau of Labor and Industries. Agency officials say there is a direct correlation between the location of the parking space, and the man’s eventual death from a fall in the bathroom.

According to the report, the Oregon BOLI claims that the injuries and resulting death would not have occurred if the landlord had not violated the Fair Housing Act by denying the tenant’s close-in parking request.
