Judge Overrules Safety Inspector

This week, a judge in Georgia refused to enforce an order by a local fire inspector to vacate and condemn a multifamily building for safety violations.newspaper1-300x225

According to a news report, the judge did not think the order, which would have displaced 16 families, was necessary.

The fire department had served the order to vacate, citing repair issues as an “imminent danger” to the residents. The landlord told reporters that he was working on the repairs, but the order to vacate came as a surprise.

After a hearing, the judge ruled in favor of the building owner. According to the report, the judge was not satisfied with the fire official’s definition of “imminent danger” and ruled that the tenants can stay while repairs are completed.

The owner was ordered to complete repairs within 60 days, according to the report.
